What is an Eviction Commitment?

An eviction commitment is a document in rental law where the tenant promises to vacate the property on a specified date. If properly prepared, it provides landlords with a faster legal eviction process.

Validity Conditions

For an eviction commitment to be legally valid, certain conditions must be met:

  • The document must be written
  • The tenant must sign it voluntarily
  • It must not be signed on the same day as the rental agreement

Blank Eviction Commitments

Sometimes tenants sign blank documents. Legally, signing a blank document may imply consent for it to be filled later. However, if it is proven that it was obtained on the same day as the rental agreement, the commitment may be considered invalid.

Eviction Process

If the tenant does not vacate the property on the promised date, the landlord can initiate enforcement proceedings or file an eviction lawsuit.

Legal action must be initiated within one month from the promised evacuation date, otherwise the right to eviction based on the commitment may be lost.

Rental law requires strict tracking of deadlines and procedural rules. Any incorrect notification or missed legal period may result in rejection of the eviction request. Therefore, eviction commitments, rental agreements, and eviction procedures must be conducted correctly from a legal standpoint.
